Terms of Service

Important: By creating an account and using SafeOrbit360, you agree to these Terms. The platform may only be used to monitor individuals with proper legal authorization or informed consent. Unauthorized monitoring of adults is illegal and will result in immediate account termination.

1. Acceptance of Terms

By accessing or using the SafeOrbit360 platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to all terms, you may not use the Service. These Terms apply to all users, including individuals, families, businesses, schools, and organizations.

2. Eligibility

You must be at least 18 years of age to create a SafeOrbit360 account. By creating an account, you represent that you meet this requirement and that all information you provide is accurate, current, and complete.

3. Permitted Use

You may use SafeOrbit360 to monitor: • Devices owned by you • Devices belonging to minor children under your legal guardianship or parental authority • Devices issued by your organization to employees, under a disclosed and legally compliant monitoring policy • Vehicles and assets owned by your organization You must comply with all applicable laws, including but not limited to wiretapping laws, privacy laws, and employment laws in your jurisdiction before deploying the Service.

4. Prohibited Use

You may NOT use SafeOrbit360 to: • Monitor any adult individual without their knowledge and explicit consent (unless legally authorized, e.g., as a legal guardian of a dependent adult) • Stalk, harass, intimidate, or surveil any individual for unlawful purposes • Collect data in violation of any applicable law, including GDPR, CCPA, ECPA, or equivalent statutes • Share, sell, or otherwise transfer monitored data to unauthorized third parties • Attempt to reverse-engineer, decompile, or tamper with the SafeOrbit360 platform • Use the Service for any fraudulent, deceptive, or criminal activity Violation of this section will result in immediate account termination and may be reported to relevant law enforcement authorities.

5. Account Responsibilities

You are responsible for: • Maintaining the confidentiality of your account credentials • All activity that occurs under your account • Ensuring that all monitored individuals are informed and legally authorized per your jurisdiction • Promptly notifying us of any unauthorized access at security@safeorbit360.com

6. Subscription and Billing

Free plan features are available indefinitely at no charge. Paid plans (Basic, Premium, Enterprise) are billed monthly or annually as selected. All prices are displayed in USD and are exclusive of applicable taxes. Subscriptions auto-renew at the end of each billing period. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period. We reserve the right to modify pricing with at least 30 days written notice to active subscribers.

7. Data Ownership

You retain ownership of all data collected by the SafeOrbit360 agent on devices you are authorized to monitor. By using the Service, you grant SafeOrbit360 a limited license to process, store, and display this data for the sole purpose of providing the Service to you. We do not claim ownership of your data.

8. Service Availability

We target 99.9% monthly uptime, excluding scheduled maintenance windows (announced at least 24 hours in advance). We are not liable for downtime caused by third-party infrastructure providers, force majeure events, or actions outside our reasonable control.

9. Limitation of Liability

SafeOrbit360 is a monitoring tool — it does not guarantee the physical safety of any individual. We are not liable for: • Harm resulting from a failure to detect or alert on a safety event • Data loss due to device offline periods exceeding the agent buffer capacity • Legal consequences arising from your use of the Service in violation of applicable law • Loss of profits, indirect, incidental, or consequential damages Our total liability to you for any claim arising from use of the Service is limited to the amounts you paid us in the 3 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if you violate these Terms. You may terminate your account at any time from account settings. Upon termination, your data is retained for 30 days then permanently deleted.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email and dashboard notice at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance.

12. Governing Law

These Terms are governed by and construed in accordance with the laws applicable to the registered entity operating SafeOrbit360. Disputes shall first be attempted to be resolved via good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration.
